Denver’s New Revenue Minefield

The city of Denver, like most other major metropolitan cities, is facing historic budget deficits. In the face of those fiscal challenges, city officials need to be creative about finding new sources of revenue.

While nothing has been officially decided, Denver city officials are finding out that these creative new sources of revenue can quickly become a dangerous political minefield.

Some of the ideas that have come down as ways to increase revenues are bound to raise as many hackles as they will potential revenue.

One of the ideas that is getting the most traction, and raising the biggest stink, is the proposal to begin charging Denver residents for trash pick-up.

While some critics of the idea are basing their arguments on calling it a tax, versus a fee, and thereby making it subject to TABOR, the louder complaints are coming from the projected money that would be made by the program.

Current proposals claim that if Denverites are charged $15/month for trash pick up; it will bring in as much as $26 million dollars into Denver coffers.

The problem is that current trash services only cost the city around $15 million dollars.

It seems the big problem with the idea for many Denver voters is the fact that Denver is proposing to take a free service away and not only charge enough to pay for it, but charge enough to make a tidy profit.

And while $26 million would make a big difference in the city’s budget deficit of over $100 million, it looks like the extra $11 million that is currently proposed as “profit” may not be worth the cost in political capital.

Another idea that hasn’t received has much attention, yet, is the proposal to begin charging for parking meters on Sundays. Estimates of how much money this idea would bring in were not currently available, but it won’t take a political historian to remind city officials that Denverites are very touchy about what they pay for parking.

Our current Governor, John Hickenlooper, used his proposal to make parking meters $1.00 an hour, and Sundays free, to propel his political career. Going back on that proposal will likely remind city officials why making Sundays free made Hickenlooper so popular.

Certainly, the current economic situation calls for officials to be creative and consider even controversial funding ideas. And no citizen will ever be thrilled about paying more money for anything, fee, tax or anything else.

But recent history shows that there are some funding ideas that officials will need to be very careful negotiating. If Denver’s city officials fail to heed that advice, they will hand future candidates a direct strategy to successfully replace them.

Sex Club Files Suit Against DPD

DENVER (CBS4) – The owner and two volunteers at a former Denver swingers club filed a civil lawsuit this week against the Denver Police Department claiming officers used excessive force on an employee, then stole a videotape that police believed showed the incident.

Denver police are strongly disputing the charges of stealing evidence.

“That’s absolutely untrue,” said Denver police spokesman Lt. Matt Murray when told of the lawsuit accusations. “I think they are seeing something and trying to make something bigger out of it.”

The lawsuit arises out of a DPD raid on the Scarlet Ranch, a swingers club that was located at 424 Broadway in Denver. The club has since moved to a new location in Littleton.

Videotape broadcast by CBS4 shows Denver vice officers entering the club May 5, 2010 as part of an investigation into potential illegal drug use and unlicensed alcohol sales at the establishment. Within a few minutes, the officers encountered Bradley Mitchell, who is characterized as a club member and “volunteer.”

When officers asked Mitchell for keys so they could enter the club’s office, Mitchell refused to provide the keys, insisting on seeing a search warrant, which the officers did not have and said they did not need.

Officers then arrested Mitchell for interference. Videotape shows Mitchell, who was seated, being pulled up by an officer and forcefully thrown to the ground. Several officers strike Mitchell who they say was uncooperative, hostile and resisting arrest.

“I determined the suspect posed a significant officer safety risk to myself and the officers posted nearby,” wrote Sgt. Daniel Steele.

“There was no justifiable basis to do that,” said attorney Lonn Heymann, who represents the club. “When they got a little pushback they got frustrated and angry and took out that frustration on Brad.”

Mitchell told the vice officers that the takedown had been recorded by a surveillance camera. Additional videotape then shows the officers in another room at the club, searching for the recorder that held the surveillance tape Mitchell had mentioned. Officers can be seen finding a machine, climbing up on a chair and removing a videotape from the machine. However the tape that they removed was not the surveillance tape and was unrelated to what had occurred.

On an evidence log listing what the officers took from the Scarlet Ranch that night, there is no mention of the videotape officers are seen removing from a machine.

“Our theory of why they took the tape is they were destroying evidence of the previous wrongful excessive force,” said Heymann. “They believed they had footage of what had happened. That’s our allegation and complaint. Under the circumstances, a reasonable explanation is they were trying to destroy evidence of what they had done,”

Heymann said the tape in question was a movie, not club surveillance video.

Heymann said the tape disappeared and was never seen again. He accuses police of trying to “steal and conceal.”

“Members of Vice Team 50 attempted to conspire to cover-up and conceal the evidence of police misconduct,” the lawsuit states.

“It’s easy to make these kinds of accusations,” Murray said.

Murray told CBS4 there is a completely innocent explanation for what the club cameras recorded. He acknowledges officers went hunting for the surveillance tape.

“They have to document what happened in that room, so they were looking for it as evidence in his new case of resisting arrest and for our use of force investigation. They were looking for a tape to document what happened in the room,” Murray said.

Murray described the accusations in the lawsuit as having “no merit, no basis. Officers should be looking for evidence like that. That’s exactly what they should be doing and I think that’s what the public expects them to do.”

He said the videotape was not mentioned on the police evidence log of what was taken because he insisted officers left it behind when they determined it was not a surveillance tape and not relevant to their investigation.

“There’s no cover up,” Murray said.

Heymann said the tape in question was not left behind by police and was never located after the raid.

Police charged Mitchell with resistance, interference, dispensing alcohol without a license and providing glasses/mixers for alcohol. He said he was jailed for 13 hours. But five months after the raid, a Denver judge dismissed all criminal charges against Mitchell, apparently because a police officer did not show up for multiple court appearances.

Heymann said his clients hope the lawsuit leads to policy and procedural changes at the Denver Police Department and compensation for the violation of their constitutional rights.

DENVER (CBS4) - As only we told you on Wednesday, it would be a struggle to get out of the 60s with the passage of a cold front on Thursday. And indeed the high on Thursday was just 67 degrees – 22 degrees colder than Wednesday. That cold front also brought a layer of clouds that quickly burned off to reveal mostly sunny skies.

Skies will stay sunny for Friday as we begin another quick warm up with a high close to 80.

The weekend brings sunshine and a return to summer-like temperatures: highs in the low to mid 80s. Might see a chance for an isolated storm by late Sunday. Next week will see temperatures fall to the more seasonal 70s.

Officers Make Sure Drivers Are Aware Of The ‘Move Over Law’

ARVADA, Colo. (CBS4) – Move over or get a ticket. That’s the message police are sending out as they step up enforcement of Colorado’s Move Over Law.

Police say not knowing the law is not an excuse.

The Move Over Law requires drivers to move over a lane when there’s an emergency situation along the shoulder. If the driver can’t move over, they must slow down significantly to avoid an accident.

It’s a danger police encounter almost daily, which is why the Move Over Law was created.

“That law has requested drivers on a highway or a roadway with two or more adjacent lanes to move over to the next lane,” Officer David Snelling with the Arvada Police Department said.

This week Denver area law enforcement is looking to enforce the Move Over Law. They let CBS4′s Evrod Cassimy ride along as they looked for drivers in violation.

“A police officer could be doing anything on the side of the road right now,” Snelling said.

Within minutes Cassimy saw officers pull several drivers over. One woman claimed she didn’t know it was the law.

“For a law that’s been in effect for five or six years, not having knowledge of it really shouldn’t be an excuse at this point,” Snelling said.

The Move Over Law is more than just a law for the Arvada Police Department. It hits close to home. More than 30 years ago one of their own was pulled over on the side of the road during a routine traffic stop when he was hit and killed by a passing motorist. Today a memorial for that officer sits in a glass case in the lobby of the police department. It’s a reminder of why they enforce the law.

Minutes into the enforcement police stopped a driver who not only moved over to avoid the traffic stop but nearly missed his exit in doing so.

“Safety is the most critical component. These guys are out here every day trying to do their job. The last thing they need to be is hit,” driver Thomas Berry said.

The law has been in effect since 2005. Those who are caught can expect an $87 ticket.

Law enforcement reports that from 1993 to 2009 one officer was hit and killed every month on the nation’s highways.

Moody: Don’t Let A French Comedy From 1643 Scare You Away

DENVER (CBS4) – It’s a French comedy from 1643, but don’t let that scare you away. “The Liar,” as presented by the Denver Center Theatre Company, is very up to date.

CBS4 Critic at Large Greg Moody reviewed the performance.

“As with any French comedy, ‘The Liar’ is fast moving, full of mistaken identities, fancy costumes, people rushing on and off stage, and a couple of references to hip hop,” Moody said. “Okay — so it’s maybe not as traditional as you’d think.”

Teller County Sheriff’s Office Falls Victim To Credit Card Fraud

TELLER COUNTY, Colo. (CBS4) – The Teller County sheriff and three of his deputies are among at least 100 people victimized by a credit card scam.

The sheriff said he used his debit card in the town of Divide last week. Suspicious charges started showing up this week.

The card had been used in stores along the East Coast and in the south.

“We live in hard economic times and as a result of that these types of crimes are happening,” Teller County Sheriff Mike Ensminger said.

The sheriff isn’t sure how the crimes happened but his department is investigating. He said it is a lesson that everyone should check their bank accounts frequently.

Golden Police Search For Man Who Robbed Wells Fargo Bank

GOLDEN, Colo. (CBS4) – Golden police are looking for the man who robbed a Wells Fargo bank Thursday morning.

The suspect told tellers he had a weapon but never showed one. Nobody one was hurt. The suspect got away with cash.

The suspect is a white man in his 40s and about 6 feet tall. He may have been wearing a wig and a fake beard.

Anyone with information is asked to call Golden police.

Much Talked About Tebow Billboard Now On Display

DENVER (CBS4) – The highly talked about billboard asking the Denver Broncos to play Tim Tebow is now up in Denver.

It’s a digital board at 58th and Logan and it claims to represent Broncos fans. It asks coach John Fox to play the second-year quarterback.

Tebow has only seen the field briefly and that was as a wide receiver in the second game of the season against the Cincinnati Bengals when the Broncos were hit with injuries.

“I don’t think much surprises me anymore, but I’m sure there are a lot of billboards. I just don’t get downtown much to see it,” Fox said. “What I’m concerned about is that locker room. Our locker room is fine.”

The billboard was put up by a local fan.

More High Profile Groups Oppose Sick Pay Initiative

DENVER (CBS4) – More high profile groups are speaking out against Initiative 300. That’s the Denver proposal to force employers to pay for sick time.

On Thursday the Hispanic, black and women’s chambers of commerce came together to oppose the measure. They all say it would hurt small businesses.

“We think there is an undue burden put on our small firms due to this initiative. We think it makes it harder for our small firms to hire new employees,” James Mejia with the Hispanic Chamber of Commerce said.

Proponents of the sick time initiative say employees are forced to make a bad decision between working sick or going a day without pay.

Denver Job Expo Caters To Only Veterans

DENVER (CBS4) – Hundreds of thousands of veterans are among those looking for work. They came home from serving the country only to join the unemployment lines.

Some companies are trying to hire veterans and they joined and impressive job expo held in Denver on Thursday.

Forty companies were looking to hire. There were companies like Lockheed Martin, Verizon and Raytheon at the expo. But nobody had an offer like Chuck Gaertner had. He didn’t have a booth, but he did have an opening at his carpet cleaning business in Steamboat Springs. So he stood outside and handed out a letter explaining that after 25 years, he was retiring.

“I’m looking for a successor,” Gaertner said.

Someone had helped him get his start and now he said it was his turn.

“I want to pick someone who has fire in their belly,” he said.

He wanted a veteran.

“Because I think they deserve it.”

And they need it.

At the job expo they showed up by the hundreds. They were veterans like James Sarles, who served 13 years in the Navy.

“Starting over; hitting the reset button in life,” Sarles said.

But civilian life is a different world. Justin Tolbert enlisted 12 years ago.

“When I joined it was, if you wanted job you could go out there and get it,” Tolbert said. “Now it’s like if you want a job you have to wait and wait.”

That’s why Recruit Military was founded. It’s an organization that hosts job fairs just for veterans.

“We know the challenges they face so we’re here to help bridge the gap,” a Recruit Military official said.

“It makes me feel like there’s somebody on our side, someone willing to give us a chance,” Sarles said. “I couldn’t ask for anything more but a chance.”

It’s a chance Chuck Gaertner says all veterans deserve.
